Resolving a dispute
While most tenancies are problem free, sometimes an issue can arise which needs help to resolve. The most common problems occur when:
- there is poor communication, or
- the terms of the tenancy agreement are not met, and/or
- people do not understand their rights and responsibilities.
An example of a dispute caused by poor communication: The lessor/agent entering the tenant’s home without giving proper notice.
An example of not meeting the terms of the agreement: A tenant not reporting that a tap is broken to the lessor/agent.
The best way to avoid disputes is to talk to each other as soon as an issue arises and to be aware of your rights and responsibilities when renting.
Steps to sorting out your dispute
- The RTA encourages self-resolution by talking to each other first and trying to reach an agreement
- If this is not possible the RTA’s Dispute Resolution Service may be able to help by providing advice and a conciliation service. A Dispute resolution request (Form 16) can be lodged with the RTA to start this process
- If the dispute is still not sorted out the tenant/lessor/agent can take their dispute to the Tribunal for a decision
In urgent situations, the tenant or lessor/agent can apply directly to the Tribunal without first lodging a Dispute resolution request with the RTA.
