Extending a tenancy
A periodic agreement continues indefinitely until either party gives notice to end it.
A fixed agreement can be extended by signing a new agreement.
Fast facts
- If the Notice to leave (Form 12) or Form R12 for rooming accommodation is not given and no new tenancy agreement put in place, the tenancy continues as a periodic agreement under the same terms and conditions of the original agreement.
- The tenant can stay on under a new fixed term agreement. If there are no changes other than the dates, this can be done by both parties signing a letter or statement with the new dates. If there are changes a new tenancy agreement will need to be put in place.
- The rent can be increased between two fixed term tenancies if both parties agree.
