Fair wear and tear

The term fair wear and tear is not defined in the Act or the tenancy agreement. The standard terms of the tenancy agreement gives an example of what may be fair wear and tear:

  • wear that happens during normal use, or
  • changes that happen with ageing

The best way to avoid disputes about fair wear and tear is by properly and thoroughly completing the Entry condition report (Form 1a or 1b) or Form R1 for rooming accommodation at the commencement of the tenancy noting all damage and deterioration.

 

Taking photographs will help to support this report.
