Role of the Small Claims Tribunal

Download Handling Tenancy Disputes in the Small Claims Tribunal as a PDF (845kB)

The Small Claims Tribunal is part of the Queensland court system and is one of several tribunals that deal with specialised legal matters. (Other examples of such tribunals are the Anti-Discrimination Tribunal and the Childrens Services Tribunal.) Tribunals tend to be less formal than courts and are not bound by the rules of evidence. For example, the referee can choose to hear evidence that is not sworn evidence.
Essentially, the role of the Small Claims Tribunal is to hear and resolve tenancy disputes. To settle or resolve matters, the referee often makes certain orders.
