Rental law changes introducing minimum housing standards came into effect for new tenancies (including renewed tenancy agreements) from 1 September 2023, and will come into effect for all remaining tenancies on 1 September 2024.

Retaliatory action occurs when the property manager/owner gives a Notice to remedy breach, a Notice to leave or increases the rent in response to the tenant asserting their rights to intimidate or punish them.

If the tenant reasonably believes the action was taken to intimidate or punish them for asserting their rights under the Act, the tenant can make an urgent application to QCAT within 1 month of becoming aware of the property manager/owner's action.

The tenant should note that a QCAT application is evidence-based. They may not achieve their desired outcome and they should consider this when making an application.
