In moveable dwelling tenancies, tenants rent a moveable dwelling or its site from a property manager/owner. Tenants may also have access to common facilities like bathrooms, laundries and kitchens.
A moveable dwelling agreement is typically used when renting a:
- caravan
- caravan site
- moveable dwelling
- manufactured home in a caravan park.
Moveable dwelling agreements do not apply if you are staying in a caravan park for a holiday or if you own a manufactured home in a caravan park.
The Residential Tenancies and Rooming Accommodation Act 2008 (the Act) lists the rights and responsibilities of people who live in, own and manage moveable dwelling tenancies.
What is a moveable dwelling tenancy agreement?
A Moveable dwelling tenancy agreement (Form 18b) is the agreement between a tenant and a property manager/owner that sets out the terms that apply to long tenancies (over 42 days).
The property manager/owner must give the tenant a copy of the Moveable dwelling tenancy agreement on or before the day they move into the property. If the tenant is not given an agreement to sign, they still have protection under the law.
If the tenant rents a caravan, site or manufactured home in a caravan park, a copy of any park rules must also be given to the tenant. Park rules form part of the terms of the agreement.
What is the property manager/owner responsible for?
For short and long tenancies, the property manager/owner is responsible for:
- meeting all the costs of preparing the agreement
- ensuring the correct form is used and completed (for long tenancies)
- giving the tenant copies of the:
- tenancy agreement (for long tenancies)
- park rules
- Pocket guide for tenants – caravan parks (Form 17b)
- Entry condition report – moveable dwelling/site (Form 1b) (optional for short tenancies).
- signing and returning the agreement to the tenant within 14 days after receiving a signed copy (for long tenancies)
- making sure the property is in a good state of repair and ready for the tenant to move in on the agreed date.
